An Irish Passion for Justice reveals the life and work of Paul O''Dwyer, the Irish-born and quintessentially New York activist, politician, and lawyer who fought in the courts and at the barricades for the rights of the downtrodden and the marginalized throughout the 20th century.Robert Polner and Michael Tubridy recount O''Dwyer''s legal crusades, political campaigns, and civic interactions, deftly describing how he cut a principled and progressive path through New York City''s political machinery and America''s reactionary Cold War landscape. Polner and Tubridy''s dynamic, penetrating depiction showcases O''Dwyer''s consistent left-wing politics and defense of accused Communists in the labor movement, which exposed him to sharp criticism within and beyond the Irish-American community. Even so, his fierce beliefs, loyalty to his brother William, who was the city''s mayor after World War II, and influence in Irish-American circles also inspired respect and support. Recognized by his gentle brogue and white pompadour, he fought for the creation of Israel, organized Black voters during the Civil Rights movement, and denounced the Vietnam War as an insurgent Democratic candidate for US Senate. Finally, he enlisted future president Bill Clinton to bring an end to the Troubles in Northern Ireland. As the authors demonstrate, O''Dwyer was both a man of his time and a politician beyond his years. An Irish Passion for Justice tells an enthralling and inspiring New York immigrant story that uncovers how one person, shaped by history and community, can make a difference in the world by holding true to their ideals.

Why are women still at a disadvantage in Chinese divorce courts?Despite the increase of gender consciousness in Chinese society and a trove of legislation to protect women, why are Chinese women still disadvantaged in divorce courts? Xin He argues that institutional constraints to which judges are subject, a factor largely ignored by existing literature, play a crucial role. Twisting the divorce law practices are the bureaucratic incentives of courts and their political concerns for social stability. Because of these concerns, judges often choose the most efficient, and safest, way to handle issues in divorce cases. In so doing, they allow the forces of inequality in social, economic, cultural, and political areas to infiltrate their decisions. Divorce requests are delayed; domestic violence is trivialized; and women’s child custody is sacrificed. The institutional failure to enforce the laws has become a major obstacle to gender justice.Divorce in China is the only study of Chinese divorce cases based on fieldwork and interviews conducted inside Chinese courtrooms over the course of a decade. With an unusual vantage point, Xin He offers a rare and unfiltered view of the operation of Chinese courts in the authoritarian regime. Through a socio-legal perspective highlighting the richness, sophistication, and cutting-edge nature of the research, Divorce in China is as much an account of Chinese courts in action as a social ethnography of China in the midst of momentous social change.

How tax law perpetuates injustice but might instead be used as a powerful force for creating a more just and equitable society The relationship between tax law and society, Anthony C. Infanti asserts, is too often overlooked by those who work outside of the field of fiscal policy. Yet, the way a country collects and spends its revenue can be viewed as a quantifiable reflection of how a country sees itself, sending messages about both what it values now and what it aspires to be in the future.Tax and Time sheds light on two of the most misunderstood universal human experiences: time and taxes. Anthony C. Infanti asserts that time in tax law is the product of pure imagination and calls into question the world beyond time that we have created for ourselves. Written with clarity and powerful insight, Tax and Time demonstrates how the tax laws have been used to imaginatively manipulate time in ways that perpetuate economic and social injustice. With its social justice focus, the book brings a sorely needed critical perspective to technical tax policy discussions. Infanti calls for a systematic reexamination and reworking of the relationship between time and tax law, asserting that the power of the legal imagination to manipulate time in tax law can both correct past injustices and help us to envision—and actually work toward—a better and more just society.

A user’s guide to understanding contemporary free speech issues in the United StatesAmericans today are confronted by a barrage of questions relating to their free speech freedoms. What are libel laws, and do they need to be changed to stop the press from lying? Does Colin Kaepernick have the right to take a knee? Can Saturday Night Live be punished for parody? While citizens are grappling with these questions, they generally have nowhere to turn to learn about the extent of their First Amendment rights. The Fight for Free Speech answers this call with an accessible, engaging user’s guide to free speech. Media lawyer Ian Rosenberg distills the spectrum of free speech law down to ten critical issues. Each chapter in this book focuses on a contemporary free speech question—from student walkouts for gun safety to Samantha Bee’s expletives, from Nazis marching in Charlottesville to the muting of adult film star Stormy Daniels— and then identifies, unpacks, and explains the key Supreme Court case that provides the answers. Together these fascinating stories create a practical framework for understanding where our free speech protections originated and how they can develop in the future. As people on all sides of the political spectrum are demanding their right to speak and be heard, The Fight for Free Speech is a handbook for combating authoritarianism, protecting our democracy, and bringing an understanding of free speech law to all.

Shines a light on the emerging field of law dedicated to responding to and resolving the crises of the twenty-first centuryIn an increasingly globalized world, a complex and interlocking web of nations, governments, non-state actors, laws, and rules affect human behavior. When crisis hits—whether that be extrajudicial detention, unprompted deportation, pandemics, or natural disasters—lawyers are increasingly among the first responders, equipped with the knowledge necessary to navigate the regulations of this ever more complex world.Crisis Lawyering explores this phenomenon and attempts to identify and define what it means to engage in the practice of law in crisis situations. In so doing, it hopes to sketch out the contours of the emerging field of crisis lawyering. Contributors to this volume explore cases surrounding domestic violence; dealing with immigrants in detention and banned from travel; policing in Ferguson, Missouri; the kidnapping of journalists; and climate change, among other crises. Their analysis not only serves as guidance to lawyers in such situations, but also helps others who deal with crises understand those crises—and the role of lawyers in them—better so that they may respond to them more effectively, efficiently, collaboratively and creatively. Crisis Lawyering shines a light on the emerging field of law dedicated to responding to and resolving the complex crises of the twenty-first century.

Insider details from the takedown of Backpage, the world’s largest sex trafficker, by the prosecutor who led the charge For almost a decade, Backpage.com was the world’s largest sex trafficking operation. Seven days a week, twenty-four hours a day, in 800 cities throughout the world, Backpage ran thousands of listings advertising the sale of vulnerable young people for sex. Reaping a cut off every transaction, the owners of the website raked in millions of dollars. But many of the people in the advertisements were children, as young as 12, and forced into the commercial sex trade through fear, violence and coercion. In Taking Down Backpage, veteran California prosecutor Maggy Krell tells the story of how she and her team battled against this sex trafficking monolith. Beginning with her early career as a young DA, she shares the evolution of the anti-human trafficking movement. Through a fascinating combination of memoir and legal insight, Krell reveals how she and her team started with the prosecution of street pimps and ultimately ended with the takedown of the largest purveyor of human trafficking in the world. She shares powerful stories of interviews with survivors, sting operations, court cases, and the personal struggles that were necessary to bring Backpage executives to justice. Finally, Krell examines the state of sex trafficking after Backpage and the crucial work that still remains. Taking Down Backpage is a gripping story of tragedy, overcoming adversity, and the pursuit of justice that gives insight into the fight against sex trafficking in the digital age.
